Cayman Web Innovations Ltd ("we", "us", or "our") values the rights of intellectual property holders and anticipates that our users will do the same. In compliance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will promptly address claims regarding copyright infringement occurring via our services if such claims are communicated to our Designated Copyright Agent as outlined in the sample notice below.

If you hold copyright, are granted permission to act on behalf of a copyright holder, or have exclusive rights under copyright law, kindly report any suspected copyright violations occurring on or through our website (the "Site") by completing the DMCA Notice of Alleged Infringement and submitting it to our Designated Copyright Agent. Upon receiving notice as detailed below, we will take any actions we consider appropriate, which may include the removal of the allegedly infringing content from the Site.

DMCA Notice of Alleged Infringement ("Notice")

1. Specify the copyrighted work that you assert has been infringed, or if multiple works are included in this Notice, provide a representative list of those works.
2. Identify the potentially infringing material or link, including at a minimum, if applicable, the URL of the link displayed on the Site or the specific location of the material in question.
3. Include your company affiliation (if applicable), mailing address, phone number, and, if available, your email address.
4. Incorporate both of the following declarations in the Notice:
* "I hereby declare that I possess a good faith belief that the disputed use of the copyrighted content is not endorsed by the copyright owner, its representative, or under the law (e.g., as fair use)."
* "I hereby declare that the information in this Notice is accurate and, under penalty of perjury, that I am the copyright owner, or am authorized to act on behalf of the copyright owner, of the copyright or exclusive right that is allegedly infringed."
5. Provide your full legal identity and your electronic or handwritten signature.

Please be aware that under Section 512(f) of the DMCA, anyone who knowingly falsely claims that material or activity is infringing could face legal liability.

Counter-Notification

If you believe that the material removed (or to which access was blocked) is not infringing, or that you have permission from the copyright holder, their representative, or based on legal provisions, to use the content, you may submit a counter-notice that includes the following information to our Designated Copyright Agent:

1. Your physical or digital signature;
2. Identification of the content that was removed or access that was disabled, and the location where the content was present prior to its removal or disablement;
3. A statement indicating that you have a good faith belief that the content was taken down or disabled mistakenly or due to misidentification;
4. Your name, address, phone number, email address, a statement consenting to the jurisdiction of the federal courts in Seychelles, and a statement indicating your willingness to accept service of process from the individual who issued the notification of claimed infringement.

Upon receiving a counter-notice, our Designated Copyright Agent may send a copy to the original complaining party to inform them that we might restore the removed content or stop its disablement within 10 business days. If the copyright owner does not initiate legal action seeking a court order against the content provider or user, the content may be reinstated or access to it restored, at our sole discretion, within 10 to 14 business days or longer after we receive the counter-notice.

Repeat Infringer Policy

Following the DMCA and relevant laws, we have established a policy for terminating users who are identified as repeat infringers in suitable circumstances and at our sole discretion. Additionally, we may choose to limit access to the Site and/or terminate the accounts of any users that infringe upon others' intellectual property rights, regardless of prior infringements.
